Welcome to SigmaTau Design Ltd (“we,” “our,” “us”). By engaging our services or placing an order through our website https://sigmatau.co.uk, you (“the client,” “you”) agree to be bound by the following Terms and Conditions. Please read them carefully before proceeding.
1. Services Offered
We provide the following services:

Graphic Design: Custom digital designs, including logos, branding materials, and marketing assets.

Web Design: Landing page design and development, including domain registration and hosting setup via Hostinger.

Mobile Application Design and Development: Custom design and development of mobile applications.

Printed Materials: Custom designs printed and delivered via a third-party professional print company.
All services are subject to these Terms and Conditions.
2. Agreement and Payment Terms

Quotation and Acceptance: After an initial consultation if the existing packages do not suit your needs, we will provide a quotation for a bespoke project contract (Prices Varie). Acceptance of the quotation and payment of the deposit constitute agreement to these Terms and Conditions. – Payment terms can be discussed and are subject to change.

Deposit: A non-refundable deposit of £50 is required before work commences on Monthly Payment contracts and bespoke projects.

Final Payment: Your last payment date for 12/24/36/48 will be provided.

Payment Methods: Payments can be made via WooCommerce payments, google pay, apple pay, amazon payments, stripe or bank standing order for monthly payments as arranged.

Late Payments: Late payments may incur additional fees, and we reserve the right to suspend work and websites until payment is received.

12/24/36/48 Month Contracts: Contracts are available for domain names and web packages – Prices available on website.
3. Design Process and Revisions

Initial Concepts: We will present initial design concepts based on your brief. You are entitled to 2 rounds of revisions at no extra cost.

Additional Revisions: Further revisions beyond the included rounds will be charged at our standard hourly rate of [insert rate].

Client Responsibilities: You are responsible for providing timely feedback, approvals, and any necessary materials (e.g., text, images). Delays in providing these may extend project timelines.

Final Approval: Once you approve the final design, no further changes can be made without incurring additional costs. For printed materials, approval confirms that the design is ready for printing, and we are not liable for any errors in the approved design.
4. Delivery

Digital Designs: Final digital files will be delivered via [insert method, e.g., email, Google Drive] in the agreed format.

Printed Materials: Printed materials will be produced and delivered by a third-party print company directly to your specified address. Delivery times are estimates and may vary.

Web Design and Mobile Applications: Websites and mobile applications will be delivered electronically, with access provided upon completion and final payment.
- Third-Party Printing Services: We use a reputable third-party print company for printed materials. While we strive to ensure quality, we are not liable for delays, errors, or defects caused by the print company. Any issues must be reported to us promptly so we can address them with the print company on your behalf.
5. Refunds and Cancellations

Digital Design Services (including Web Design and Mobile Applications): Due to the custom nature of our work and the time invested, refunds are not available once the design process has commenced (i.e., after the deposit is paid and initial concepts are presented). However, we are committed to your satisfaction and will offer revisions as outlined in Section 3 to ensure the final product meets your expectations.

Printed Materials:

If printed materials are defective or damaged upon receipt, please notify us within 7 days. We will arrange for a reprint or a full refund at our discretion.

We are not responsible for errors in the design that were approved by you prior to printing.

Cancellations:

If you cancel a project before work commences, we may offer a partial refund of the deposit, minus any administrative fees.

Cancellations after work has begun are not eligible for a refund.
- 12/24/36/48 Monthly contracts cannot be cancelled once the domain name is registered and the site design has commenced.

6. Intellectual Property

Ownership: Upon full payment, ownership of the final design will be transferred to you, and you will have the right to use it for your intended purposes.

Portfolio Rights: We retain the right to display the design in our portfolio, website, and marketing materials unless otherwise agreed in writing.

Preliminary Designs: We retain ownership of all preliminary concepts, sketches, and drafts not selected for final use.
7. Web Design and Mobile Application Services

Domain and Hosting: For web design projects, domain registration and hosting are provided through Hostinger. You are responsible for maintaining your domain and hosting subscriptions after the initial setup.

Maintenance and Updates: Any ongoing maintenance, updates, or support for websites or mobile applications after project completion will be subject to additional fees.

Liability: We are not liable for any downtime, data loss, or issues related to third-party hosting or app store services.
8. Limitation of Liability

Our liability for any claim arising from our services is limited to the total amount paid by you for the project.

We are not liable for any indirect, consequential, or incidental losses, including but not limited to loss of profits, data, or business opportunities.

We are not responsible for delays or failures caused by factors beyond our control, including third-party services, natural disasters, or client delays.
9. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Amendments
We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our website, and the revised terms will apply to all new projects initiated after the update.
11. Contract Terms for Domain Names and Web Packages

Contract Options: We offer 12, 24, 36 and 48-month contracts for domain names and web packages, including hosting, domain renewal, and ongoing maintenance. Pricing is available upon request (P.O.A).

48-Month Contract Example (Price may vary): For a single-page website with a simple backend admin, the contract is from £15 per calendar month for 48 months (£720 at 0% apr). This included:

Domain registration and renewal for the term.

Hosting via Hostinger.
-
One small update or improvement per month, as requested by the client, graphics or otherwise.

Legally Binding Agreement: By agreeing to the contract terms via any communication method, including Facebook Messenger, you are entering into a legally binding agreement. This agreement is enforceable under the laws of England and Wales.

Payment Obligations: You are obligated to make monthly payments for the full term of the contract. Failure to make payments may result in:

Suspension of services, including website hosting and access to the backend admin.

Legal action to recover outstanding payments.

Early Termination: Early termination of the contract may result in penalties or fees, including the full remaining balance of the contract.

Evidence of Agreement: Agreements made via Facebook Messenger or other digital communication methods may be used as evidence in legal proceedings.
